A former colleague of mine was sued by his previous company here. We actually worked together after he left that company, but he eventually resigned again because of this legal case.
He lost the case, even though he claimed that everything he did was proper and according to his contract. He said he resigned respectfully and on time, and his coworkers even held a farewell party for him.
Apparently, the issue had to do with Qiwa, an online employment portal recently introduced to manage work contracts and resignations. It’s a great system, but it was new, and some workers like us who signed paper contracts pre-Qiwa didn’t know much about it.
According to him, his former company allegedly created a Qiwa contract with a different start and end date from his original paper contract. So, when he filed his resignation thinking his contract ended in July, the Qiwa record allegedly showed a December end date instead. That meant, legally, it looked like he broke his contract — even though he said he had no idea about the electronic one.
He lost both the initial case and the appeal to the high court, since the electronic contract is also considered valid under the law. Ignorance of the law excuses no one, indeed!
Now, he’s facing a financial penalty of about 56,000 SAR (around 900,000 PHP or 15,000 USD). This would eventually lead to other issues such as possible service bans for banking, ID renewals, and travel. He will also find it hard to be employed since he won’t have valid ID.
He is an overseas worker from a 3rd world country and he is not paid a good sum of money to cover this, plus the fact that he is jobless.
He is appealing for any help to raise the amount. It doesn’t matter how small — any contribution could make a difference. I know that you don’t know him. I don’t know him well enough even! Yes, he could be telling the truth or you may feel like he is scamming us, but if you find it in your heart to support, please do lend a hand.
As for me, I help him because he is already in this predicament, no further appeals can be done and all he must do is pay. I already asked several lawyers too, they all said the same thing. The fine has been executed. He’s already been charged in the bank (he barely have any money in it), next steps shall follow if the amount remains unpaid.
